Terms and Conditions

1)     Following the Consumer Contracts Regulations (2013), the client is entitled to a 14-day cooling off period.

a) The client’s 14-day cooling off period begins on the day of employment of FJ Property Care Ltd, irrespective of how this is communicated to the team, i.e. verbally (face to face), via email, text, phone call or any other means. It is usually following a discussion about the price of the job listed on the quote or estimate, with a clear agreement about duration of project and start date.

b) Where a deposit is involved, the 14-day cooling off period will begin on the day any payment is made by the client to FJ Property Care Ltd, whether by cash, bank transfer or other means.

Voiding the 14-day cooling off period:

i) Workers on-site terminates the 14-day cooling off period. FJ Property Care Ltd take great pride in planning projects to ensure that our service always remains fair and in the favour of the customer, it is common practice for work to start 14-days after a deposit is paid in full. Should workers arrive onsite sooner, this will void the remaining “cooling off” days and any labour provided will be included in the invoice.

ii) If no deposit is paid and the FJ team arrive on-site to do work, this is classed as an emergency job and will be charged accordingly. An invoice will be generated for having workers on site.

2) FJ Property Care Ltd reserves the right to request payment for any work done, including labour and/or materials supplied to the customer.

a) An invoice will be sent to the client, and a payment is expected by midnight of the date due. Any payment made later than this is subject to incur late payment charges, unless an exception is explicitly discussed and agreed upon prior to the due date. Where this is the case, FJ Property Care Ltd will send a confirmation email of that conversation. The customer is encouraged to have these discussions and follow the instruction documented on the invoices: if a client is struggling to make a payment they are encouraged to speak to a member of the FJ Team about implementing a payment plan.

b) To resolve any disputes, FJ Property Care Ltd reserves the right to adjust any bill to reflect labour and/or materials supplied to the customer, irrespective of the level of completion of the project, payments cannot be held ransom for incomplete or delayed projects. In the event of a dispute, this clause will overrule any other promises similar (but not limited to) the following clauses: “completing work to the customer’s satisfaction,” “finishing until complete,” and, “up to basic finish and white paint.”

FJ Property Care Ltd will make reasonable adjustments for clients organising their own projects, who are delayed by other trades or services, however, should this period become prolonged, we reserve the right to send an invoice for work done so far, and should the client wish to re-employ our services for the remainder of their project, they are free to do so.

When an invoice is sent, a due date will be supplied.

2)     It is normal practice for FJ Property Care Ltd to ask for a deposit prior to commencing work. The client is usually then asked to wait 14 days to allow time for the cooling off period.

a.      Upon cancelling a project, if work is commenced within the 14-day cooling off period, all work will cease immediately and the site will be made safe. FJ Property Care LTD reserve the right to charge for labour and materials for any works done during that time, up to the point of cancellation.

i.     The value of the labour and/or materials will be tallied and deducted from the deposit.

ii.     If no deposit was paid, the client will be sent a final bill of a tally of labour and materials up to the point of cancellation.

b.      If the client cancels the project within the 14-day cooling off period, and no work was started but a deposit was made, FJ Property Care Ltd will return their deposit, minus admin fees.

c.      If a deposit was paid and the client cancels the job, and if it is found that the deposit was not enough to cover the work done, a bill will be sent to cover the difference.

3) Labour is not limited to bricklayer/ labourer services, and also includes administrative and project management services; likewise, materials is not limited to sand/ cement, and also includes office supplies and other equipment necessary to carry out and/ or promote the work - this is not an exhaustive list.

4) FJ Property Care Ltd reserve the right to refuse to start work until the deposit is made in full, unless otherwise agreed.
